The Ed platform, edstem.org and Ed company ACN 607 247 272 (hereafter referred to as "Ed" or "we" or "our") has developed these terms that govern your access to, use of, and participation in the website, platform, applications and related internet technologies hereafter referred as the "Service".
1. Terms
By using the Ed platform and Service you agree to be bound by these terms of service, applicable laws and regulations and you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using the platform and service or accessing this website. Materials on this website are protected by copyright law.
2. Use of Our Service
Subject to the terms in this policy, in conjunction with the terms of any other agreement between Ed and the institution, you are hereby granted a non-exclusive, limited, non-transferable, license to use the Ed platform on a hosted service. The license shall terminate if you violate any of these restrictions.
3. Responsibilities
Institution and instruction staff will create, maintain, supervise and regulate course content and online discussion, group messaging and activity. Ed will maintain the software platform, provide hosting and provide technical support to institution and instruction staff.

The materials on the Ed website are provided on an 'as is' basis and we make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Ed does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
5. Limitations
In no event shall Ed or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Ed, even if Ed or an Ed authorized representative has been notified orally or in writing of the possibility of such damage. In the United States these terms are governed by and construed in accordance with the laws of California and you irrevocably submit to the exclusive jurisdiction of the courts in this State or location. In Canada these terms are governed by and construed in accordance with the laws of Ontario and you irrevocably submit to the exclusive jurisdiction of the courts in this Province or location. In Europe these terms are governed by and construed in accordance with EU Law and you irrevocably submit to the exclusive jurisdiction of the courts in the relevant location. In the United Kingdom these terms are governed by and construed in accordance with English law and UK law and you irrevocably submit to the exclusive jurisdiction of these courts. In other countries these terms are governed by and construed in accordance with the laws of the Commonwealth of Australia and the state of New South Wales and you irrevocably submit to the exclusive jurisdiction of the courts in this State or location.
